Terms of Service

These Terms establish the legal relationship between Ensuric and every person who accesses or uses the Platform, including visitors, registered users, merchants and authorised business representatives.

Ensuric is operated by Ensuric Softwares & Solutions LLP. Further information about the operator and the nature of the Platform is available on our About Us page.

Some present or future Platform features may be governed by additional policies, guidelines or feature-specific terms. Where those documents are stated to apply, they form part of these Terms.

In these Terms:

Platform

means the Ensuric website, related applications, APIs, communications and services made available by Ensuric.

Ensuric

means Ensuric Softwares & Solutions LLP, the operator of the Platform.

User

means any person who accesses or uses the Platform, including visitors and registered users.

Merchant

means a business, professional, organisation or service provider listed or seeking to be listed on the Platform.

Merchant Listing

means a business profile or related information displayed on the Platform.

Content

means text, images, photographs, videos, logos, reviews, ratings, documents, data and other material available on or submitted through the Platform.

User Content

means Content submitted, uploaded, posted or otherwise provided by a User or Merchant.

You may use the Platform only if:

• You are legally capable of entering into a binding agreement under applicable law
• Your use of the Platform is not prohibited by applicable law
• You comply with these Terms and all policies that apply to the relevant feature
• Information you provide is accurate, current and not misleading

If you use the Platform on behalf of a business, organisation or other legal entity, you confirm that you are authorised to bind that entity and act on its behalf.

Certain Platform features may require registration, mobile-number verification, authentication or another form of account access.

When creating or using an account, you agree to:

• Provide accurate and complete information
• Keep account information reasonably up to date
• Protect your credentials, devices and one-time passwords
• Not share authentication codes with unauthorised persons
• Promptly report suspected unauthorised access or misuse

You are responsible for activity carried out through your account unless that activity results solely from a failure within Ensuric's reasonable control.

Ensuric may introduce additional account types, merchant dashboards, organisation accounts, team access or authentication methods as the Platform develops.

Merchant Listings may be created using information submitted by a Merchant, an authorised representative, the Ensuric team or lawfully accessible public sources.

Listings may be reviewed, categorised, formatted, standardised, corrected, merged, restricted or removed where reasonably necessary to maintain Platform quality, safety and consistency.

The rules governing listing eligibility, creation, claiming, verification, correction, moderation, suspension and removal are set out in the Merchant Listing Policy.

The presence of a Merchant Listing does not by itself establish endorsement, certification, partnership or agency. Further details are provided in the Platform Disclaimer.

You must use the Platform lawfully, responsibly and in a manner that does not harm Ensuric, other Users, Merchants or third parties.

You must not:

• Use the Platform for unlawful, fraudulent, deceptive or abusive activity
• Impersonate another person, Merchant or organisation
• Submit false, misleading, fabricated or manipulated information
• Post fake reviews, ratings, claims, reports or other deceptive Content
• Harass, threaten, defame or unlawfully discriminate against another person
• Upload malware, harmful code or material intended to disrupt the Platform
• Attempt unauthorised access to accounts, systems, networks or data
• Circumvent security, authentication, rate limits or access controls
• Scrape, crawl, harvest, copy or bulk-extract Platform data without prior written permission, except lawful search-engine indexing
• Use Platform Content to build or enrich a competing directory, dataset, model or service without prior written permission
• Reverse engineer or attempt to derive source code except where such restriction is prohibited by law
• Interfere with the availability, integrity or normal operation of the Platform
• Infringe intellectual-property, privacy or other legal rights

Ensuric may investigate suspected misuse and take reasonable technical, operational or legal action.

The Platform may allow Users or Merchants to submit Content such as business information, images, corrections, reviews, ratings, reports, comments, collections or other material.

By submitting User Content, you confirm that:

• You own the Content or have all permissions required to submit it
• The Content is lawful and does not infringe another person's rights
• The Content is accurate to the best of your knowledge where it states facts
• The Content does not contain malicious code or unlawfully disclosed personal information
• Submission and use of the Content as contemplated by these Terms will not breach another agreement

You grant Ensuric a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to host, store, reproduce, adapt for formatting or technical purposes, display, communicate and distribute User Content as reasonably necessary to operate, maintain, improve, secure and promote the Platform.

This licence does not transfer ownership of your User Content to Ensuric. It continues only for as long as reasonably necessary for the purposes described above, subject to backups, legal retention requirements and Content already shared or incorporated into the Platform.

Ensuric may review, restrict, reject or remove User Content that violates these Terms, applicable law or Platform policies, but is not obliged to pre-screen all Content.

The Platform, including its software, source code, design, branding, logos, databases, search systems, interfaces, original text, graphics and documentation, is owned by or licensed to Ensuric and is protected by applicable intellectual-property laws.

These Terms give you a limited, non-exclusive, non-transferable and revocable right to access and use the Platform for its intended purposes. They do not transfer ownership of Ensuric's intellectual property.

Merchants and Users retain ownership of Content they lawfully own, subject to the licence granted under these Terms.

Third-party names, logos, trademarks and Content remain the property of their respective owners. Their appearance on the Platform does not imply ownership or endorsement by Ensuric.

The Platform may integrate with, rely on or link to third-party services such as mapping, authentication, analytics, hosting, communications, social-media, payment or merchant-operated services.

Third-party services operate independently under their own terms, policies and technical conditions. Ensuric does not control and is not responsible for their independent availability, security, content or conduct.

Ensuric may introduce features such as merchant dashboards, listing claims, reviews, ratings, collections, bookings, appointments, enquiries, subscriptions, advertisements, premium listings, online payments, APIs, mobile applications and other business or community tools.

Additional terms, policies, pricing, eligibility conditions or consent requirements may apply when such features are introduced. Where there is a conflict, feature-specific terms will govern the relevant feature to the extent of that conflict.

Unless Ensuric expressly states otherwise, any transaction, booking, purchase or service engagement remains directly between the User and the Merchant. Ensuric's role is further explained in the Platform Disclaimer.

Ensuric may add, modify, restrict, suspend or discontinue any part of the Platform where reasonably necessary for maintenance, security, legal compliance, product development or operational reasons.

Temporary interruptions may occur because of maintenance, technical failures, internet or infrastructure issues, third-party outages, security incidents or circumstances beyond Ensuric's reasonable control.

Unless expressly agreed in writing, Ensuric does not guarantee uninterrupted access, permanent availability of any feature or a specific service level.

Ensuric's collection, use, storage, sharing and protection of personal data are governed by the Privacy Policy.

Merchants and third-party services may process information under their own privacy practices. Users should review those practices before sharing personal information directly with them.

To the maximum extent permitted by applicable law, the Platform is provided on an "as is" and "as available" basis.

Ensuric does not guarantee the accuracy, completeness, legality, availability, quality or suitability of every Merchant Listing, product, service, review, third-party link or item of Content.

Detailed information concerning Ensuric's role, independent Merchants, information accuracy, verification, transactions, category-specific services and user responsibilities is provided in the Platform Disclaimer. That document should be read as part of these Terms.

To the maximum extent permitted by applicable law, Ensuric Softwares & Solutions LLP and its partners, employees, contractors and representatives shall not be liable for indirect, incidental, special, exemplary, punitive or consequential loss, including loss of profits, revenue, business opportunity, goodwill, data or anticipated savings, arising from or relating to:

• Use of or inability to use the Platform
• Reliance on Merchant Listings or other Platform Content
• Interactions, transactions or disputes between Users and Merchants
• Products or services offered or supplied by Merchants
• Third-party services, websites, applications or payment providers
• Temporary interruptions, technical failures or unauthorised activity beyond Ensuric's reasonable control
• Removal, restriction, suspension or modification of Content, listings, accounts or features in accordance with these Terms

Where liability cannot lawfully be excluded, Ensuric's liability will be limited to the extent permitted by applicable law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including any mandatory rights available under applicable consumer law.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Ensuric Softwares & Solutions LLP and its partners, employees, contractors and representatives from claims, losses, liabilities, damages, costs and reasonable expenses arising from:

• Your breach of these Terms or another applicable Platform policy
• Your unlawful, fraudulent or unauthorised use of the Platform
• User Content submitted by you
• Your infringement of another person's rights
• Your business activities, products, services or customer interactions where you act as a Merchant or Merchant representative

This section does not require indemnification for losses caused solely by Ensuric's own unlawful conduct.

Ensuric may restrict, suspend or terminate access to an account, listing, feature or the Platform where reasonably necessary to:

• Address a breach of these Terms or another Platform policy
• Prevent suspected fraud, abuse, impersonation or unlawful activity
• Protect Users, Merchants, third parties or Platform security
• Comply with legal, regulatory or judicial requirements
• Address repeated complaints, inaccurate information or operational risk
• Discontinue a feature or service

Where appropriate, Ensuric may instead remove Content, restrict a feature, request corrective action or require additional verification.

Provisions that by their nature should survive termination, including those concerning intellectual property, liability, indemnity, disputes and governing law, will continue to apply.

Ensuric may update these Terms to reflect changes in the Platform, business operations, legal requirements or risk controls.

The revised Terms will be published on this page with an updated effective date. Where required by applicable law, Ensuric may provide additional notice or seek renewed consent before a material change takes effect.

Continued use of the Platform after revised Terms take effect constitutes acceptance of those Terms to the extent permitted by law.

These Terms are governed by and interpreted in accordance with the laws of India.

Subject to any mandatory dispute-resolution or consumer rights under applicable law, the courts at Gurugram, Haryana shall have exclusive jurisdiction over disputes arising from or relating to these Terms or use of the Platform.
